Настоящие условия — публичная оферта ИП ТУРСУНКУЛОВ (далее — «мы») на использование сервиса Sezgir Chat (sezgir.com, chat.sezgir.com, мобильное приложение). Регистрируясь или оплачивая подписку, вы (компания или индивидуальный предприниматель, далее — «клиент») принимаете эти условия.

Сервис

Sezgir Chat — облачный сервис для бизнеса: единое окно переписки с покупателями (Instagram Direct, Facebook Messenger, WhatsApp, Telegram, чат на сайте) и AI-помощник, который отвечает покупателям от имени клиента, показывает товары и услуги из его каталога, оформляет заказы и записи и выставляет счета на оплату.
Instagram и страница Facebook подключаются официальным входом Meta через Instagram API и Messenger Platform; WhatsApp — через WhatsApp Business Platform. Клиент может отключить канал в любой момент.

Аккаунт

Клиент указывает достоверные данные, отвечает за сохранность доступа и за действия своих сотрудников в аккаунте.
Клиент подключает только те аккаунты, страницы и номера, которыми он владеет или вправе управлять.

Тарифы и оплата

Действующие тарифы указаны на sezgir.com. Первые 3 дня — бесплатно. Подписка оплачивается помесячно счётом Kaspi из кабинета.
Если подписка не оплачена, AI-ответы приостанавливаются; переписка и данные сохраняются, доступ к кабинету остаётся.

Обязанности клиента

Соблюдать законодательство Республики Казахстан и правила платформ, которые он подключает (в том числе правила Instagram, Facebook, WhatsApp и Telegram).
Не использовать сервис для спама, рассылок без согласия получателей, мошенничества, продажи запрещённых товаров и услуг, а также для сбора данных людей, которые не обращались к клиенту.
Указывать в каталоге и описании бизнеса достоверные цены, наличие и условия: AI опирается на эти данные.

AI-помощник

AI отвечает на основе данных, которые предоставил клиент, и может ошибаться. Клиент видит все диалоги, может в любой момент перехватить разговор или выключить AI.
Ответственность за содержание каталога, цены и выполнение заказов перед покупателями несёт клиент.

Сторонние платформы

Instagram, Facebook, Messenger и WhatsApp — товарные знаки Meta Platforms, Inc. Sezgir Chat не является продуктом Meta и не связан с ней иначе как пользователь её официальных API. Работа каналов зависит от правил и доступности этих платформ.

Данные

Мы обрабатываем данные по поручению клиента и только для работы сервиса — подробно в Политике конфиденциальности (sezgir.com/privacy/). Удаление данных — sezgir.com/data-deletion/.

Ответственность

Сервис предоставляется «как есть». Мы делаем всё разумное для бесперебойной работы, но не отвечаем за перебои сторонних платформ и упущенную выгоду. Наша ответственность ограничена суммой, оплаченной клиентом за последний месяц.

Прекращение

Клиент может прекратить пользоваться сервисом и удалить аккаунт в любой момент. Мы можем приостановить аккаунт при нарушении этих условий или правил подключённых платформ.

Прочее

Мы можем обновлять условия, публикуя новую редакцию на этой странице. К отношениям применяется право Республики Казахстан.

Terms of Service

These terms are the public offer of IE TURSUNKULOV (ИП ТУРСУНКУЛОВ) ("we") for the use of Sezgir Chat (sezgir.com, chat.sezgir.com and the mobile app). By signing up or paying for a subscription, you (a business or sole proprietor, the "client") accept them.

The service

Sezgir Chat is a cloud service for businesses: one inbox for conversations with customers (Instagram Direct, Facebook Messenger, WhatsApp, Telegram, website chat) and an AI assistant that replies to customers on the client’s behalf, shows products and services from the client’s catalog, takes orders and bookings and issues payment requests.
Instagram accounts and Facebook Pages are connected with Meta’s official login through the Instagram API and the Messenger Platform; WhatsApp through the WhatsApp Business Platform. The client can disconnect a channel at any time.

Account

The client provides accurate details and is responsible for keeping access safe and for what their staff do in the account.
The client connects only accounts, pages and numbers they own or are authorized to manage.

Plans and payment

Current plans are listed on sezgir.com. The first 3 days are free. The subscription is paid monthly by a Kaspi payment request from the client panel.
If the subscription is unpaid, AI replies are paused; conversations and data are kept and the panel stays accessible.

Client obligations

Comply with the law of the Republic of Kazakhstan and the rules of the platforms they connect (including Instagram, Facebook, WhatsApp and Telegram policies).
Do not use the service for spam, messaging people without their consent, fraud, selling prohibited goods or services, or collecting data of people who did not contact the client.
Keep prices, availability and terms in the catalog and business description accurate: the AI relies on them.

AI assistant

The AI answers from the data the client provided and can make mistakes. The client sees every conversation and can take over or turn the AI off at any time.
The client is responsible to their customers for the catalog, prices and fulfilment of orders.

Third-party platforms

Instagram, Facebook, Messenger and WhatsApp are trademarks of Meta Platforms, Inc. Sezgir Chat is not a Meta product and is not affiliated with Meta other than as a user of its official APIs. Channels depend on the rules and availability of those platforms.

Data

We process data on the client’s behalf and only to run the service — see the Privacy Policy (sezgir.com/privacy/). Data deletion: sezgir.com/data-deletion/.

Liability

The service is provided "as is". We take reasonable care to keep it running but are not liable for outages of third-party platforms or lost profits. Our liability is limited to the amount the client paid for the last month.

Termination

The client can stop using the service and delete the account at any time. We may suspend an account that breaches these terms or the rules of the connected platforms.

Other

We may update these terms by publishing a new version on this page. The law of the Republic of Kazakhstan applies.
